These Terms and Conditions ("Terms") govern the use of leafdeflector.com and Leaf Deflector pages, forms, and online resources that link to these Terms (the "Site"). The Site is operated by Leaf Deflector ("Leaf Deflector," "we," "us," or "our").
Please read these Terms before using the Site. When a feature presents these Terms and asks you to agree, checking the agreement box or taking another action clearly identified as acceptance signifies your agreement. If you do not agree, do not use a feature that requires that agreement. These Terms otherwise apply only to the extent an agreement is formed under applicable law.
Our Privacy Policy explains how we handle personal information. Accepting these Terms or submitting an inquiry does not, by itself, provide consent to optional advertising cookies, recurring marketing texts, or artificial or prerecorded marketing calls.
1. Who the Site is for
The Site provides information about Leaf Deflector gutter guards, product resources, contractor and distributor opportunities, supply-house relationships, and customer support. Our products and business services are offered only to customers in the United States. The Site does not offer a homeowner shopping cart or direct online checkout.
You must be at least 18 and have authority to act for yourself or the business you represent when submitting a business application or entering an agreement with us. Information you submit must be accurate, and you must have permission to provide another person's information.
2. Inquiries and business relationships
Submitting a contact form, requesting product information, or expressing interest in carrying or installing Leaf Deflector products does not itself:
- Place an order or create a purchase or installation contract.
- Establish an approved contractor, dealer, distributor, employment, or agency relationship.
- Guarantee product availability, pricing, territory rights, exclusivity, referrals, sales, profit, or any particular response time.
- Enroll you in recurring billing or a marketing text-message program.
A purchase, installation, contractor, distributor, or other business arrangement is governed by the applicable separate agreement and any rights provided by law. These Site Terms do not replace those agreements.
We may connect you with a representative, contractor, distributor, or supply house when you request that assistance. Your information will be handled as described in the Privacy Policy.
3. Independent contractors, distributors, and sellers
A contractor, installer, distributor, or supply house that sells, recommends, or installs Leaf Deflector products may be an independent business. Its listing or use of our products does not, by itself, make it our employee or agent.
An independent business is responsible for its own contracts, pricing, licensing, insurance, permits, installation work, customer communications, and other legal obligations. Before hiring an installer, review the installation agreement and verify the credentials relevant to your project.
Leaf Deflector remains responsible for its own obligations, including applicable product warranties and duties imposed by law. Nothing in these Terms excuses conduct or liability that cannot lawfully be excluded.
4. Product information and installation
We make reasonable efforts to provide accurate product information. Availability and product details may change. Before ordering or installing, review the current specifications, installation instructions, and written warranty for the product you intend to use. A later website update does not retroactively change an existing purchase agreement or applicable warranty.
Website photographs, examples, and general guidance do not establish that a product is appropriate for every gutter, roof, property, or installation. Product selection and installation must account for the actual site conditions, applicable instructions, and local requirements.
Information on the Site is general product information. Obtain project-specific advice from a qualified contractor or other appropriate professional when needed. Installation and work at height involve risks and should be performed using appropriate training, equipment, and safety practices.
5. Fire, wildfire, and code-related information
References to wildland-urban interface (WUI) compliance, Class A classifications, or ASTM E84 or ASTM E2768 testing relate to the particular product, test, and conditions described in the applicable documentation. A reference to a testing standard does not, by itself, mean that ASTM or a government agency certifies, endorses, or approves the product. These references do not establish that an entire home, roof, or gutter assembly has a particular fire rating or meets every local requirement.
Leaf Deflector gutter guards are not a guarantee against ignition, wildfire loss, or property damage. Gutter guards do not replace other required maintenance, inspections, defensible-space measures, or home-hardening work. Local code applicability and acceptance depend on the project and the authority having jurisdiction. These references do not guarantee permit approval, an insurance discount, insurance eligibility, or protection against a particular wildfire event.
Consult the relevant product documentation and your local building or fire authority for project-specific requirements. Nothing in this section changes an express warranty or representation that is enforceable under applicable law.
6. Product warranty and clog-free guarantee
References to Leaf Deflector's 45-Year Product Warranty and No-Clog Gutter Guarantee refer to the applicable written warranty or guarantee and enforceable product representations, subject to applicable law. A product warranty and a performance guarantee may cover different matters; the duration of one does not, by itself, establish the duration or coverage of the other.
These Terms are website terms, not the product warranty or guarantee. They do not create additional registration deadlines, transfer restrictions, installer requirements, maintenance conditions, exclusions, or remedies beyond the applicable written documents and law.
Review the product warranty on our Warranty page and obtain the applicable written warranty and any separately advertised guarantee before purchasing. The version and promises applicable to your purchase govern, subject to applicable law; later website changes do not reduce existing rights. Nothing in these Terms eliminates an enforceable express or implied warranty, limits a right that cannot legally be waived, or converts a product sold with a warranty into an "as is" sale. A conflicting statement in another document cannot waive rights that applicable law makes nonwaivable.
7. Communications
When you submit an inquiry or ask us to contact you, we may respond by email or telephone about that request. You can ask us to stop marketing communications using the unsubscribe option in a marketing email or by contacting us.
We do not currently offer a recurring marketing text-message program. Any future program will require its own applicable disclosures and consent process. These Terms do not provide consent for automated marketing texts or artificial or prerecorded marketing calls.
If call recording or transcription is enabled, we provide notice and obtain the consent required by applicable law, including all-party consent where required, before recording or transcribing. These Terms do not substitute for that consent. You can use email if you do not wish to participate in a recorded conversation.
8. Ownership and permitted use of Site content
The Site's text, logos, photographs, graphics, videos, product materials, and other content are owned by Leaf Deflector or used with permission and are protected by applicable intellectual-property law.
You may view the Site and download materials expressly made available for download for lawful personal use, internal business evaluation, or another purpose stated with those materials. Preserve any copyright, trademark, and other proprietary notices.
Other commercial copying, publication, distribution, alteration, or use of our logos and branding requires permission, except where applicable law allows the use. Any separately approved contractor or distributor permission remains subject to its own terms. Ordinary use of a link to a publicly available page is permitted.
9. Information and materials you submit
Submit only information, photographs, and other materials you own or have permission to provide. Do not submit unlawful material, malicious code, another person's private information without authority, or content that infringes someone else's rights.
You retain ownership of your submitted materials. You give us a nonexclusive, royalty-free permission to copy, store, and share them only as reasonably needed to respond to your request, provide support, evaluate a business relationship, or administer a warranty, consistent with our Privacy Policy. This permission lasts only as long as reasonably needed for those purposes and applicable recordkeeping obligations. It is not a general license to publish your materials.
Submitting a project photograph or support request does not, by itself, grant permission to use your name, likeness, or materials in public advertising. We will seek appropriate permission for that use. Nothing in these Terms prohibits an honest review, penalizes you for a review, or requires you to transfer ownership of a review.
10. Prohibited use
You may not use the Site to commit fraud, impersonate someone, send spam, collect personal information without authorization, distribute malware, interfere with Site operation, or attempt to access nonpublic systems or information without permission.
Automated access must not bypass access controls, overwhelm the Site, or violate applicable law or third-party rights. This section does not prohibit ordinary public search-engine indexing or other automated access we authorize.
We may restrict access when reasonably necessary to address misuse, protect security, or comply with law.
11. Third-party links and services
The Site may link to or use services operated by others, including forms, social media, and contractor or distributor websites. Those services may have their own terms and privacy policies. We do not control their independent content or practices. Our use of a service provider does not remove any responsibility we have under applicable law.
12. Site availability and website disclaimers
We may update, suspend, or discontinue Site features. We do not guarantee that the Site will always be available, error-free, or compatible with every device or browser.
To the extent permitted by law, the Site and its general informational features are provided "as is" and "as available," without implied warranties concerning uninterrupted access, error-free operation, or suitability of the Site for a particular purpose.
This website disclaimer does not disclaim product warranties, excuse misleading product claims, or limit obligations under a purchase, installation, or other separate agreement. It does not affect rights that cannot legally be excluded.
13. Limits on liability for website use
To the extent permitted by law, Leaf Deflector is not liable for indirect, incidental, special, or consequential losses arising solely from use of, or inability to access, the Site, such as lost data or business interruption caused by website unavailability.
This limitation does not apply to product defects, installation obligations, bodily injury, property damage, applicable product warranties, fraud, gross negligence, willful misconduct, violations of law, or any liability or remedy that cannot legally be limited. Some jurisdictions do not permit certain limitations, and those limitations will not apply where prohibited.
14. Governing law and your rights
California law governs these Terms, except that mandatory protections under applicable federal law and the law of your state remain available where they cannot be waived.
These Terms do not require arbitration or waive the right to participate in a class action. They do not shorten a legal deadline for bringing a claim or require you to give up an available small-claims remedy.
If you have a concern, you may contact us using the information below. Contacting us first is not a condition of exercising a legal right. Nothing prevents you from communicating with a government agency or reporting a concern.
15. Changes and other provisions
We may revise these Terms by posting an updated version and changing the dates above. Revisions apply prospectively and do not alter a completed transaction or existing warranty. We provide additional notice or obtain agreement where required by law.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
These Terms govern Site use. A separate agreement accepted by the parties or applicable product warranty governs the subject it covers if it conflicts with these Terms, subject to nonwaivable law. These Terms do not enlarge or reduce remedies under those separate agreements.
